Terms

1.   Customer is the registered legal owner of the vehicle(s) and has authority to enter into this Agreement or has been duly authorized by the legal owner of the vehicle(s) to enter into this Agreement.

2.   Customer order is subject to all terms and conditions of the carrier's Bill of Lading, copies; of which are available at the office of carrier and also are incorporated herein. 

3.   Above All Auto Transport, LLC agrees to have vehicle(s) described on quotation shipped on or about the dates requested. Above All Auto Transport will assign a reliable carrier to fulfill the terms and conditions of this agreement.  Although we strive to always pick up and deliver on your requested dates, delivery dates and times are estimates only.  Date and time of delivery is not guaranteed and Above All Auto Transport will not be held liable for any loss or damage resulting from any delay.   

 4.   The deposit is due at time of order placement.  The remaining amount is due at time of delivery in cash or cashier’s check only.  The vehicle(s) will not be released if the total amount due in cash is not provided.  If delivery is attempted after notification (3 to 24 hours phone/voicemail notification to phone numbers provided by customer) and customer or their designated accepter does not have the cash amount due or is unavailable to receive delivery, vehicle(s) will be taken to the nearest terminal at Above All Auto Transport’s discretion, where the customer will have to recover and pay for storage or redelivery fees.

 5.   Customer shall prepare the vehicle(s) for transport by removing or properly securing all loose and/or protruding parts such as antennas, low hanging spoilers, etc.  Any part that falls off in transit that causes damages to any vehicle(s) involved are the customer’s responsibility.  It is necessary that the customer disarm any vehicle alarm system and provide the driver with any tools or keys necessary to disarm the system.  If activated during the transport the driver may deactivate the alarm in any way deemed necessary to disarm.  Customer releases any claims for damages that are caused by customer’s failure to provide proper keys or procedure for the driver in this event.  
 

6.   Customer is responsible for removing all detachable personal belongings from the vehicle(s).  Additional fees may be incurred for the transport of contents left in a vehicle.  Above All Auto Transport is not responsible for the safe transport of any such contents. 

7.   Customer or assigned person shall be present at the point of pick-up and delivery.  If vehicle is not made available to transporter once the pickup date has been confirmed and the driver has been dispatched, customer will be charged a fee to cover transporter fuel expenses for that dry run.  If Customer or assigned person is not present at time of delivery, the vehicle(s) will be placed in storage at owner's expense.  


8.   Above All Auto Transport provides door to door service.  In some instances depending upon the area, the driver may request that the customer meet them at a mutually convenient location such as a supermarket parking lot if the pickup area or delivery area is too congested for the truck.  This is for the safety of the truck as well as the vehicle(s) being transported.

9.  Customer authorizes Above All Auto Transport and its subcontractors to drive, park, store and otherwise operate or transport the vehicle(s) in any means necessary to fulfill the obligation of this agreement.  Customer must maintain insurance on the vehicle(s) that extends to Above All Auto Transport's operation of the vehicle(s).

10.   Customer shall identify any damage to any vehicle(s) by noting the damage on the Bill of Lading received by Customer at the time of delivery.  Above All Auto Transport must be notified within 24 hours of any damage.  Any claims related to such noted damage must be submitted in writing to Above All Auto Transport within 10 days of delivery accompanied by clear pictures and 2 estimates.  Customer hereby waives any damage claims that are not noted on the Bill of Lading or for which Customer has not submitted a written claim within 10 days of the receipt of the vehicle(s).  Above All Auto Transport will support the customer in this effort but in no way will accept responsibility for any negligence of the carrier at fault.

11.   Above All Auto Transport is a licensed and bonded Property Broker and is responsible for booking the shipment of vehicles with a licensed and insured carrier who handles their own claims.  In turn, it may take a few weeks to process you claim due to the drivers returning to their terminals with the original Bill of Lading condition report.  In no instance can Above All Auto Transport be held liable for the designated carrier's damage.  However, Above All Auto Transport will provide carrier’s insurance certificate and carrier information should any need arise.

 12.   If delivery of vehicle has not been made within 21 days of being loaded on the assigned carrier, Above All Auto Transport will provide rental car reimbursement of up to $25 per day for a limit of 7 days or total reimbursement of $175.00.  This does not include Alaska or Hawaii moves.  In order for reimbursement the rental car receipt must be provided.  Rental car reimbursement does not apply to a vehicle(s) being repaired due to damage during transport. 

13.  After Customer places an order there is the option to cancel any time prior to the vehicle(s) being assigned to a carrier at no cost to the customer.  The amount of the deposit will be lost if the vehicle is booked on a transporter before Above All Auto Transport receives customer’s cancellation via fax or email. Above All Auto Transport reserves the right to cancel your order at any time. If this right is exercised your deposit and any other fees paid will be refunded.

14.  It is the customer’s responsibility to make sure the vehicle(s) is in operating order.  An additional charge between $100 and $200 will be assessed if the vehicle becomes inoperative for any reason during the transport and was not stated to be inoperative on customer’s original order.

15.  Customer and carrier are jointly and severally liable for any and all unpaid charges including cost of collection and reasonable attorney fees.  Unless the order has been prepaid Customer shall pay amount due, including any additional charges, in cash. 

16.  Above All Auto Transport and its agents will not be responsible for vandalism or acts of God such as fire, flooding, hurricanes, hail, sand storms, tornadoes, earthquakes, objects flying from the road or sky during transport, acts of terrorism, riots, strikes, labor disputes, explosions, acts or orders of civil or military authorities, or other causes beyond reasonable control.  Shippers should maintain their own insurance for these reasons. 

17.  If Customer submits their order online via Above All Auto Transport's website or through email it is understood that the customer is placing an order and accepts the terms and conditions in lieu of Customer's signature.  This agreement supersedes all oral agreements between Above All Auto Transport and the customer and may not be altered unless done so in writing by a member of Above All Auto Transport.
